Every year, at least 1.7 million Traumatic Brain Injuries (TBIs) occur either as an isolated injury or along with other injuries.  TBI is a contributing factor to almost a third (30.5%) of all injury-related deaths in the United States, and is a leading cause of permanent disability.  Traumatic Brain Injury (TBI) is a serious public health problem in the United States.  Sadly, many of these deaths and injuries are preventable.

If you or a loved one has suffered a Traumatic Brain Injury, call the successful, experienced, skilled, knowledgeable and hard-working Bronx TBI Lawyers at Sonin & Genis. We are proud that one of our verdicts in a personal injury case was written up as one of the top jury verdicts of the year in the National Law Journal, New York Law Journal, New York Magazine, and ALM Verdictsearch.

A TBI is caused by a bump, blow or jolt to the head or a penetrating head injury that disrupts the normal function of the brain. The severity of a TBI may range from “mild,” i.e., a brief change in mental status or consciousness to “severe,” i.e., an extended period of unconsciousness or amnesia after the injury.

The brain is the most complex organ in the human body; it controls every bodily function and organ. Our very existence, and quality of life, depends upon it. The brain is a soft organ surrounded by a hard skull, with some sharp surfaces, and is easily damaged.

Traumatic Brain Injury (TBI) is not visible to the naked eye, and often only becomes apparent long after the accident that caused it.  A mild TBI is more subtle and difficult to diagnose and less often recognized by many doctors.  Unfortunately many people, and even doctors, do not recognize a TBI when it happens, and it is often not diagnosed or not diagnosed immediately.

This is understandable because frequently the severity, extent and affects of the TBI do not manifest themselves immediately.  Moreover, many doctors, even some neurologists are not specialists in TBI and do not have the specialized testing equipment or training to properly diagnose this condition.

A TBI or mild TBI will not usually be visualized on an x-ray, and may will not appear on a CT/CAT (Computerized Axial Tomography) scan or even on MRIs (Magnetic Resonance Imaging) that lack the necessary sensitivity required to reveal the diffuse axonal damage that often is a sign of a TBI.

Incredibly, many doctors and hospitals do not have or order other useful tests that may be necessary to properly diagnose TBI, such as:

  • high sensitivity MRIs
  • functional MRIs (fMRI)
  • MRS (Magnetic Resonance Spectroscopy)
  •  SPECT (Single Photon Computed Tomography)
  • PET (Positron Emission Tomography)
  • Topographic Brain Electrical Activity Mapping (BEAM) tests

While many doctors and hospitals have EEG tests (Electro Encephalogram), many do not have or use Quantitative EEG (QEEG), Evoked Potentials or Event-Related Potentials (EP and ERP).

Usually, a full neuropsychological evaluation is necessary to properly diagnose a TBI and the extent of damages suffered. Unfortunately, this is not always done, and stingy insurance companies will not always pay for all diagnostic testing that is necessary to properly diagnose the severity of a TBI.

In order to obtain proper compensation for a brain injury, you need an excellent Bronx brain injury lawyer, one that is familiar with the medicine and neuropsychology of TBI, representing you or your loved one.

The attorneys at Sonin & Genis understand the hardships involved when a person struggles to regain health after a serious injury. Brain injuries can be especially trying and the recovery can be slow. Sometimes, the recovery is only partial. Brain injuries can cause paralysis, disabilities, personality changes, and many other conditions, some of which are subtle and not immediately diagnosed.

Inappropriate behavior and personality disorders are part of a TBI.  Changes in relationships and diminishment or loss of interpersonal skills are common. Diminishment of executive function, reasoning, and logic may occur.  This not only effects work, but friendships and family.  Marriages are oftentimes a casualty of a TBI. Coping skills may be lost or diminished, and adjustment is difficult.  Isolation, depression, stress, and anxiety may reign.

Any injury takes a heavy toll emotionally and financially, but brain injuries can be especially heartbreaking. Paying for doctors, medicine, surgeries, physical therapy or counseling is too much for most families to handle. Treatment of TBI almost always requires the assistance of neurologists, neuropsychologists, or other expensive qualified specialists, and without a Bronx brain injury lawyer battling to obtain compensation, few families can afford the costs. This is especially true when the person injured cannot work or when another family member has to put their career on hold in order to care for the person suffering a debilitating brain injury.

You need a lawyer that is able to educate and teach a jury the significance and permanent consequences of these harms and losses, so that a fair jury can provide the helps and fixes that justice requires. You need a lawyer that has the knowledge and ability to successfully cross-examine the stable of defense doctors and litigation experts that the insurance companies routinely rely on to deny liability, causation and damages to deprive injured people their fair compensation.

A large percentage of brain injuries are sustained in vehicle accidents, but they are not the only cause of TBIs. Slips, trips and falls, or other trauma can also do damage to the cerebral cortex, which means construction workers, drivers, pedestrians, and tenants in apartment building or workers in office buildings with falling ceilings, are very susceptible to brain injury.

Depending on the nature of the accident, the effects of Traumatic Brain Injury include:

  • Total or Partial Paralysis
  • Loss or diminishment of cognitive function
  • Diminished ability to focus, comprehend and remember
  • Slower mental processing speed
  • Loss or diminished executive function
  • Difficulty learning
  • Personality or mood disorder or changes
  • Depression
  • Anxiety
  • Adjustment Disorder
  • Post Traumatic Stress Disorder
  • Loss or diminished muscular control
  • Decreased hand-eye coordination
  • Speech disorder
  • Loss or diminished movement
  • Headaches

Some firms will pass your case from the lawyer you retain to another lawyer who sees you as just another file. If you or a loved one has been injured in an accident and sustained a brain injury that involves a City, County, State, Public Authority, or any Municipal entity – including trips/slips on publicly owned sidewalks, incidents involving buses or subways, schools, hospitals, publicly own buildings, or the police –  a Notice of Claim, a legal document that explains your claim, is required, and must usually be prepared by your attorneys and served on the municipality within 90 days of injury, and sometimes even sooner. Some accidents involve Federally owned vehicles, Federal employees, occur on Federal property or projects that receive Federal funds, and there are separate claim requirements.
